Terms of Service

1 Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements. AllerTrac is intended for adults managing allergy information for themselves and their household, which may include profiles describing children created and controlled by the adult account holder. The Service is not intended for independent use by children.

2 The Service

AllerTrac lets you:

• create profiles with allergy/sensitivity “avoid-lists”;
• scan barcodes, photograph ingredient labels (processed on your device), or search for products;
• receive a deterministic, profile-specific result that identifies whether configured avoid-list items appear in the available product text, along with the evidence, data source, and a confidence level; and
• save products, history, pantry, lists, and emergency information.

Results are produced by a deterministic rule engine, not by an automated medical assessment. Artificial intelligence, where used, only assists with reading or proposing text that you review; it is never the authority for a risk result.

3 Your account

• You are responsible for safeguarding your login credentials and for all activity under your account.
• You must provide accurate information and keep it current.
• Notify us promptly at support@allertrac.com of any unauthorised use.
• You are responsible for the accuracy of the avoid-lists and profile information you enter. Results depend on this configuration.

4 Licence

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the Service for your personal, non-commercial use. We (and our licensors) retain all rights, title, and interest in the Service, including all software, content, trademarks, and branding. No rights are granted except as expressly stated.

5 Acceptable use

You agree not to:

• use the Service for any unlawful, harmful, or fraudulent purpose;
• rely on the Service as a substitute for reading package labels or for professional medical advice;
• reverse engineer, decompile, or attempt to extract source code, except where this restriction is prohibited by law;
• interfere with, overload, or disrupt the Service or its security (including App Check / anti-abuse measures);
• access the Service through automated means or scrape it without permission;
• submit false, misleading, infringing, or abusive content (including product corrections); or
• resell, sublicense, or commercially exploit the Service without our written permission.

We may suspend or terminate accounts that violate these Terms.

6 Medical disclaimer and assumption of risk

You acknowledge and agree that:

• AllerTrac never labels a product “safe”, “approved”, or “all clear”; a “no flagged ingredients found” result is not a guarantee of safety.
• Product databases can be incomplete, outdated, or incorrect, and manufacturers change recipes without notice.
• OCR can misread labels; low-confidence reads are reported as “Review” or “Not enough information”.
• You are solely responsible for your final decision about any product, especially for severe allergies or life-threatening conditions. In an emergency, contact your local emergency services.

7 Third-party data and services

The Service relies on third parties, including Google Firebase / Google Cloud (hosting) and product-data sources such as Open Food Facts (and potentially USDA FoodData Central, GS1, or commercial vendors). Product information may be provided under the Open Database License (ODbL) or other terms. AllerTrac is not affiliated with or endorsed by these sources and is not responsible for the accuracy, completeness, or availability of third-party data or services. Your use of third-party services may be subject to their terms.

8 User content and corrections

You retain ownership of the content you create (profiles, lists, corrections). You grant us a limited licence to host, process, and display that content as necessary to operate the Service. By submitting a product correction or other feedback, you grant us a non-exclusive, royalty-free, worldwide licence to use it to improve the Service and underlying data. You represent that you have the right to submit such content and that it is not unlawful or infringing.

9 Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we handle your information, including health-related avoid-lists and child profiles.

10 Disclaimers of warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY RESULT IS ACCURATE, COMPLETE, CURRENT, OR RELIABLE, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.

11 Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Xruseon, Inc. AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR PERSONAL INJURY OR HEALTH CONSEQUENCES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR RELIANCE ON ANY RESULT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW (INCLUDING, WHERE APPLICABLE, LIABILITY FOR GROSS NEGLIGENCE, WILFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE).

12 Indemnification

You agree to indemnify and hold harmless Xruseon, Inc. and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any rights of a third party.

13 Termination

You may stop using the Service and delete your account at any time (Settings → Delete account). We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 6, 8, 10–12, and 15) will survive.

14 Changes to the Service or Terms

We may modify the Service or these Terms. Material changes to the Terms will be posted at https://www.allertrac.com/terms with an updated date and, where appropriate, in-app notice. Your continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Service.

15 Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws rules. The courts located in Cheyenne, Wyoming will have exclusive jurisdiction, unless mandatory local consumer-protection law provides otherwise.

16 App-store terms

If you download the app from the Apple App Store or Google Play, you also agree to that store's terms. The following applies to Apple: these Terms are between you and Xruseon, Inc. only, not Apple; Apple has no obligation to provide support or maintenance for the app; Apple is not responsible for any product claims or for addressing any claims relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17 Miscellaneous

• Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• Severability: if any provision is unenforceable, the rest remains in effect.
• No waiver: our failure to enforce a provision is not a waiver.
• Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale.
